Illinois Grandparent Visitation Law: The Legal Framework

Grandparent visitation in Illinois is governed by Section 602.9 of the Illinois Marriage and Dissolution of Marriage Act. The law doesn’t treat grandparent visitation as a given right. A petition may generally be filed only when a parent has unreasonably denied visitation and that denial has caused the child undue mental, physical, or emotional harm.

The statute establishes a rebuttable presumption: it assumes a fit parent’s decisions about grandparent contact aren’t harmful to the child. The grandparent filing the petition carries the burden of overcoming that presumption with evidence of actual harm.

Who May File a Petition

Before a court will consider a grandparent visitation petition, standing must be established. Illinois law generally requires that at least one of the following circumstances applies:

A parent of the child is deceased or has been missing for at least 90 days
A parent has been declared legally incompetent
A parent has been incarcerated for more than 90 days prior to filing
The child’s parents are divorced, legally separated, or a related proceeding is pending, and at least one parent does not object to the grandparent, great-grandparent, step-parent, or sibling having visitation with the child
The child was born to unmarried parents who aren’t living together and parentage has been legally established

The child must also be at least one year old before a petition can be filed.

What Illinois Courts Consider When Deciding Grandparent Visitation

Once standing is established, the court turns to the best interests of the child. Illinois courts weigh a range of factors: the child’s own wishes, the history and quality of the grandparent-grandchild relationship, each party’s motives, and how the requested visitation would affect the child’s existing schedule and potential exposure to conflict.

Courts also consider whether the grandparent served as a primary caretaker for the child for at least six months within the preceding 24-month period. That history can carry meaningful weight in the analysis.

Once a visitation order is entered, modifying it generally requires clear and convincing evidence of changed circumstances arising after the original order. Courts must state specific findings to support any modification.

Grandparent Visitation vs. Custody & Guardianship

Visitation and custody aren’t the same, and Illinois law treats them differently. A non-parent seeking allocation of parental responsibilities (the legal term for custody) generally may only do so when the child isn’t already in the physical custody of a parent. That is a higher bar than a visitation petition.

When a parent is unavailable or unable to care for the child, a grandparent may instead pursue guardianship under the Illinois Probate Act. Guardianship generally requires the parent’s consent or a failure to object. Which path applies depends on the child’s current living circumstances and the relevant legal standards, details worth reviewing carefully before deciding how to proceed.

Filing a Grandparent Visitation Petition in Illinois

A petition for grandparent visitation is filed in circuit court. If a dissolution of marriage or parental responsibility case is already pending, the petition is generally brought within that proceeding. If no case is pending, it is filed in the county where the child resides. Proper notice to the parents is required before the court will proceed.

Illinois law also allows courts to grant electronic communication as part of a visitation order. Phone calls, video conferencing, texting, and email are all options a court may authorize, which can matter when in-person contact is geographically or logistically difficult.

Timing matters. Grandparents who wait to address a pattern of denied visitation may face a harder road later, because modifying an existing order generally requires clear and convincing evidence of new circumstances arising after that order. Documenting the denial and acting promptly can affect what evidence is available when the case is heard.
