Military Divorce in Chicago

Coordinated Illinois & Federal Strategy for Military Families

Military divorce requires an Illinois dissolution strategy that accounts for federal service protections, military retirement rules, and the practical demands of military life. Weiss-Kunz & Oliver represents service members and military spouses facing financial, parenting, and high-conflict disputes throughout the Chicago metropolitan area.

We assess state and federal issues together rather than treating military benefits or service obligations as separate concerns. Depending on the issues and level of conflict, our attorneys can pursue a resolution through negotiation, mediation, collaborative law, or litigation.

Illinois Jurisdiction in a Military Divorce

Jurisdiction determines whether an Illinois court has authority to hear the divorce and address the issues presented. Under 750 ILCS 5/401(a), either spouse must have lived in Illinois or been stationed in Illinois as a member of the armed services when the case begins and for 90 days before filing or before the court makes its finding.

Residency, military stationing, and the court where the petition is filed therefore require careful review. Chicago-area dissolution petitions proceed through the appropriate Domestic Relations Division, but filing a petition and securing authority over particular financial issues can present separate legal questions.

Military Retired Pay & the 10/10 Rule

The Uniformed Services Former Spouses’ Protection Act permits state courts to distribute military retired pay as marital property. It also establishes a Department of Defense enforcement method for qualifying court orders. The statute doesn’t automatically give a former spouse part of a service member’s retirement. A final court order must award that interest as property.

The 10/10 rule concerns eligibility for direct payment from the Defense Finance and Accounting Service. It requires at least 10 years of marriage overlapping with at least 10 years of creditable military service. Direct-payment eligibility and the underlying property award are distinct questions. Failing to satisfy the 10/10 rule doesn’t, by itself, determine whether a court may divide retirement benefits.

“Even when a case is working toward settlement, I am simultaneously preparing it for trial, because that’s the best way to settle a case effectively; and if it does not settle, you need to be prepared to try the matter and not be taken by surprise.” - Maxine Weiss-Kunz

Representation for Complex Military Divorce Matters

We represent clients in divorce and legal separation proceedings involving substantial assets, closely held businesses, parental relocation, and international Hague Convention matters. Military service adds federal benefit rules and participation concerns to issues already governed by Illinois family law.

Before founding our firm, Maxine Weiss Kunz and Amanda M. Oliver each spent 10 years in Chicago law firms trying cases and obtaining results. We bring that courtroom background to contested cases while offering mediation and collaborative law to clients seeking a negotiated resolution.

Most of our cases involve high-net-worth family law disputes and complex financial estates. That work informs our approach to financial disclosures, valuation questions, retirement interests, and disputed property claims without assuming every case should follow the same path.
